Please read these Terms of Service ("Terms") carefully before using the Zesta platform ("Service") operated by Zesta ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, browsing recipes, or using any feature of Zesta, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the Service immediately.
2. Eligibility
You must be at least 16 years old to create an account. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information during registration. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions & Billing
Zesta may offer free and paid access tiers. When live paid checkout is enabled for your platform or region, the purchase flow will display the billing cadence, renewal rules, cancellation path, and any platform-specific terms before you confirm payment. Pricing and availability may change over time.
5. Content & Intellectual Property
Recipes, images, and other content on Zesta are provided by chefs and creators who retain their respective intellectual property rights. You may view and use recipes for personal, non-commercial purposes. You may not reproduce, distribute, or commercially exploit Zesta content without written permission.
6. User-Generated Content
By posting reviews, photos, or other content ("User Content"), you grant Zesta a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content in connection with the Service. You represent that you own or have the rights to share any content you post. We reserve the right to remove content that violates these Terms or applicable law.
7. AI-Generated Content
Zesta uses artificial intelligence to provide recipe suggestions, meal plans, substitutions, and conversational assistance. AI-generated content is provided for informational purposes only. We do not guarantee the accuracy, safety, or suitability of AI suggestions. Always use your judgment, especially regarding allergens, dietary restrictions, and food safety.
8. Prohibited Conduct
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the Service or its infrastructure; (d) scrape, harvest, or collect data without authorization; (e) impersonate any person or entity; (f) upload malicious code or content.
9. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Nutritional information and AI suggestions are estimates and should not be relied upon for medical or dietary decisions without professional consultation.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Zesta shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to Zesta in the twelve (12) months preceding the claim.
11. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, upon notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, and limitation of liability.
12. Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia. For users in the European Economic Area, nothing in these Terms affects your rights under applicable EU consumer protection law. Any disputes shall be resolved in the competent courts of Riyadh, Saudi Arabia, except where mandatory consumer protection rules grant you the right to bring proceedings in your country of residence.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
